TRS may be directed by a court via a Family Law Order (FLO), to distribute a portion of your retirement benefits to an ex-spouse.
A FLO must comply with all applicable law and TRS must approve each FLO submitted.
If the TRS member does not yet receive a monthly retirement benefit, one of the following FLOs will apply:
FLO A: Will provide for an actuarially equivalent benefit distribution, payable for the Alternate Payee's lifetime.
FLO B: Will provide for a distribution of a fixed amount (not a lifetime benefit) to the Alternate Payee.
If the member already receives a monthly TRS retirement benefit, one of the following FLOs will apply, depending upon the benefit allowance elected at retirement:
FLO C: Applies if the retiree elected a Normal Form Benefit
FLO D: Applies if the retiree elected Joint and Survivor Annuity Option A, B, C, D, or E and the Alternate Payee is the Joint Annuitant.
FLO E: Applies if the retiree elected Joint and Survivor Annuity option A, B, C, D, or E and the Alternate Payee is not the Joint Annuitant
FLO F: Applies to retired participants who elected a 10- or 20- year Term Certain and Life Benefit.
